padding: 10px 0px 15px 30px;"><iframe title="광고-IfrAdRectBanner" id="AdRectangleBanner" name="AdRectangleBanner" src="http://news.nate.com/Etc/AdRectangleBanner?bViewPage=true&g_bRightAD=" width="250" height="250" frameborder="0" noresize="noresize" scrolling="no" style="font-size: 10.5pt !important;"></iframe><div id="newsmediaBanner_obj" style="font-size: 10.5pt !important;"></div></div><div id="realArtcContents" style="font-size: 10.5pt !important;">(서울=연합뉴스) 김범수 기자 = 노사정이 6월 상여금을 통상임금에 반영할 지를 놓고 본격적으로 공식 논의에 들어갈 것으로 알려지면서 이 문제가 올해 노사간 최대 쟁점으로 부상할 전망이다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">통상임금에 대해 법률상 정의는 없지만 정부는 1982년 근로기준법 시행령에 정의 규정을 도입했다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">◇통상임금이란 = 9일 근로기준법 규정에 따르면 1임금 지급기(한달 주기)내 정기적, 일률적, 고정적으로 소정 근로의 대가로 지급하는 금품을 의미한다. 근로자가 제공하는 노동력에 대한 가치 개념이라고 할 수 있다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">통상임금은 따라서 근로자의 초과 근로 수당과 향후 퇴직금 정산 등에 큰 영향을 미친다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">상여금이 통상임금에 반영되면 초과 근로 수당은 물론 퇴직금 규모가 크게 늘어나기 때문에 재계 및 사측은 강한 반대 입장을 표명해왔다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">이에 맞서 노동계는 상여금을 정해진 달 또는 분기별로 주는 사업장들이 대다수이기 때문에 상여금을 통상임금으로 인정해줘야 한다는 입장을 고수해왔다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">예를 들어 근로자가 1시간 당 1만원꼴로 정해진 기본임금을 받을 경우 소정 근로시간(8시간) 외에 2시간을 더 일하면 연장근로 가산수당률 50%를 더해 총 11만원을 받게 된다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">만일 8시간 근로시 추가되는 가족 수당을 통상임금으로 반영한다고 치면 초과 근로시 11만원 보다 더 많은 금액이 지급된다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">더욱이 상여금의 통상임금 반영 여부는 초과 근로 수당 뿐 아니라 향후 퇴직금 산정에도 막대한 영향을 미치기 때문에 이 문제를 놓고 노사간 뜨거운 공방전이 벌어져 왔다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">◇ '상여금 통상임금 반영' 놓고 행정해석·판례 엇갈려 = 현행 정부 규정에 따르면 통상임금으로 인정받으려면 1임금 지급기 내 정기성, 일률성·고정성, 소정근로의 대가성 등 크게 3가지 기준에 부합돼야 한다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">일률성·고정성과 관련해 정부는 상여금이 '전체 근로자에게 지급되지 않더라도 일정한 조건 또는 기준에 달한 모든 근로자에게 지급돼야 한다'는 조건을 충족한다는 입장이며 판례도 대체로 이와 동일한 입장이다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">그러나 1임금 지급기 내 정기성 항목에서 행정해석과 판계의 입장이 엇갈린다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">행정해석은 '(상여금이) 1임금 지급기 내에서 계속 지급돼야 정기성이 인정된다'고 보고 있고 대법원은 이를 충족시키지 않아도 통상임금으로 인정할 수 있다는 판례를 내놓았다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">지난해 3월 금아리무진 노사 소송과 관련해 대법원이 분기별로 지급되는 상여금도 통상임금으로 인정한 것이다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">◇ 고용부 "노사정 대타협으로 갈등 해소" = 고용노동부는 경제 위기 상황에서 핵심 국정 과제인 일자리 창출 및 고용률 70% 달성을 위해 '상여금 통상임금 반영' 논의를 더 이상 미뤄둘 수 없다는 입장이다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">고용부는 이에 따라 5월 한달간 '고용률 70% 달성을 위한 노사정 대표자 회의체'를 가동하면서 '상여금 통상임금 반영' 문제를 논의하기 위한 기구를 협의를 통해 만들어 6월부터 본격 가동할 계획이다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">그러나 최근 박근혜 대통령의 방미 기간 미국 GM 본사의 댄 애커슨 회장이 향후 5년간 상여금을 포함하는 통상임금 문제 해결을 전제로 한국에 80억 달러를 투자하겠다는 계획을 제시한 것으로 전해지자 극도로 고심하는 분위기다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">'상여금 통상임금 반영' 논의가 마치 특정 외국기업의 민원을 들어주기 위한 조치로 국민들에게 받아들여질 수 있기 때문이다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">특히 박 대통령을 수행한 조원동 청와대 경제수석이 애커슨 회장의 발언을 놓고 `법원이 보너스 등이 통상 임금에 포함된다는 결정을 내려 수출 경쟁력이 떨어질 수 밖에 없다'는 요지의 발언을 해, 노동계가 대화의 장에 나서기를 꺼릴지 모른다고 우려하고 있다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">고용부 관계자는 이에 대해 "대통령 방미 기간에 현지에서 통상임금 문제가 거론됐고 윤창중 대변인 경질 등 불미스러운 일도 벌어져 부담이 되는게 사실이지만 어차피 노사정이 시급히 머리를 맞대고 논의를 해야 하는 중대 사안"이라고 말했다.<br style="font-size: 10.5pt !important;"><br style="font-size: 10.5pt !important;">[email protected]<br style="font-size: 10.5pt !important;">(끝)<br style="font-size: 10.5pt !important;"></div></td></tr></tbody></table><br></div><div id="articleContetns" class="article medium" style="line-height: 1.7;
